These EdgeOne Cloud Browser Service Terms of Use (the "EdgeOne Terms") is a legally binding contract between you (the "User" or "you"), and the Tencent entity with which you are contracting under the Tencent Cloud Terms of Service ("Tencent", "we", "us" or "our"), regarding your use of the [EdgeOne] Cloud Browser Service ("Service") as an end user. In this Agreement, "User" and "Tencent" are each a "Party" to the Agreement and, together, the "Parties".
BY CHECKING OR CLICKING "CONFIRM", INDICATING YOUR ACCEPTANCE OF THESE EDGEONE TERMS IN ANY OTHER WAY, OR BY ACCESSING OR USING OF THE SERVICE, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND YOU AGREE TO BE BOUND BY, THESE EDGEONE TERMS.
Your use of the Service is additionally subject to the Tencent Cloud Terms of Service, the AI Service Terms, and the Service Rules (defined below). The "Service Rules" refer to the instructions, standards, technical specifications, operational documentation, etc., including but not limited to the Data Processing And Security Agreement ("DPSA"), the Privacy Policy ("PP"), all of which are made available on the documentation page for the Service on Tencent's official website or other relevant pages as updated by Tencent from time to time. Please read and understand the Service Rules in advance and fully comply with the same in order to enjoy the uninterrupted use of the Service.
Where there is any conflict or inconsistency between these EdgeOne Terms, the Tencent Cloud Terms of Service, the AI Service Terms and the Service Rules, the following order of precedence (in decreasing order) shall apply: (1) these EdgeOne Terms; (2) the Service Rules; (3) the AI Service Terms; (4) the Tencent Cloud Terms of Service.
Matters not expressly addressed in these EdgeOne Terms shall be governed by the relevant terms and conditions under the AI Service Terms and/or the Tencent Cloud Terms of Service, as may be applicable. Capitalised terms used in these EdgeOne Terms have the same meaning as the equivalent defined terms in the AI Service Terms or the Tencent Cloud Terms of Service, unless the context requires otherwise. For the avoidance of doubt, the Service constitutes one of the "Services" as defined under the Tencent Cloud Terms of Service.

1. Service Overview

1.1 The Service is a cloud browser tool provided by Tencent as a neutral technology provider. Subject to your compliance with these EdgeOne Terms and applicable laws and regulations, Tencent provides you with, and allows your access and use of, a remote browser operating on EdgeOne edge processing nodes, through which you are able to render the webpages of URLs specified by you (each a "Targeted Webpage") by providing valid requests and instructions, and which would enable your access to and reproduction of the content of Targeted Webpages ("Rendered Content").
1.2 The Service may offer you one or more device configurations and feature combinations. Please carefully read the Service Rules before activating the Service, and choose and purchase the specific Service scope, option, combination or package based on your needs and circumstances. Tencent will provide the Service to you in accordance with your selection.
1.3 Before using the Service, you should carefully read the Service Rules (including any Service instructions), operate in accordance with the relevant operating guidelines, and carefully assess the risks. You understand and acknowledge that you will be responsible for the results of your own actions in using the Service.
1.4 You are responsible for the integrity and confidentiality of your login and password for using the Service. You shall bear all losses and consequences arising from the loss or leakage of the aforementioned credentials for accessing the Service due to any failure in keeping them secure and confidential.
1.5 The Service may be upgraded, adjusted, changed, or terminated from time to time due to changes in laws, regulations, or regulatory policies, Tencent's operational adjustments, industry technological developments, etc at Tencent's sole discretion. Tencent reserves the right to adjust or discontinue the Service in accordance with the relevant provisions in Tencent Cloud Terms of Service.

2. Permitted Use and Restrictions

2.1 You shall only use the Service and Rendered Content in compliance with these EdgeOne Terms, the Tencent Cloud Terms of Service, the AI Service Terms and the Service Rules, and only in relation to Targeted Webpage in relation to which you have obtained the Necessary Consents (as defined below).
2.2 You shall not use the Service or Rendered Content for or to do any of the following, or cause or result in any such effect:
2.2.1 Using the Service to crawl, scrape, copy, or store any content, data, or information protected by copyright law, trademark law, patent law, trade secret law, etc., without Necessary Consents, or otherwise violating or infringing the Intellectual Property Rights or other personal or proprietary rights or interests of any rights owners or holders of Targeted Webpage or Rendered Content or any third parties (including but not limited to copyright, patent, portrait rights, reputation rights, privacy rights, rights to any trade secrets and other legitimate rights and interests);
2.2.2 Using the Service to crawl, collect, process or store Personal Data, or otherwise violating or breaching any applicable privacy or personal data protection laws and regulations;
2.2.3 use the Service on or create Rendered Content from Targeted Webpage:
2.2.3.1 without Necessary Consents to access the Targeted Webpage;
2.2.3.2 by malicious web scraping, distributed denial-of-service attacks, or circumventing or bypassing any website security mechanisms or access restrictions (such as paywalls or other technological restrictions) or any prohibitions or restrictions against data crawling or scraping (e.g. robots.txt, CAPTCHAs, anti-crawler firewalls, etc.),
2.2.3.3 in violation or contravention of any legal provisions, statements, terms or conditions or published rules of such Targeted Webpage; or
2.2.3.4 in a manner that hinders or interferes with the normal functions or services of the Targeted Webpage, or causes the Targeted Webpage to malfunction, add, delete, or modify its systems, applications or data, or consuming Tencent resources at an unreasonable frequency, rate, or scale;
2.2.4 engage in illegal or criminal activities, or assist, facilitate, aid or abet the illegal or criminal activities of others;
2.2.5 cause any other harm (e.g. financial harm, harm to the physical and mental health, discrimination, reputational harm, and other adverse effects on rights and freedoms) to Tencent, its Affiliates, other End Users or individuals;
2.2.6 create, upload, copy, publish, transmit, disseminate or reproduce any content that violates applicable laws and regulations, or which is obscene, explicit, indecent, profane, vulgar, offensive or otherwise inappropriate for public display; or
2.2.7 jeopardise the stability or security of the Service, the EdgeOne edge nodes, or Tencent's operations, affects the Service provided to other users, or infringe upon the legitimate rights and interests of others.
2.3 When using the Service or Software, you should not use or attempt to use technical measures or other means to carry out any of the following:
2.3.1 extract data or output from the Service or Software by any automated or programmed method, including scraping, collecting or extracting data;
2.3.2 without the prior written consent of Tencent, make available to third parties the Service or Software by any means, such as leasing, lending, selling, distributing, reselling or transferring;
2.3.3 store or transmit Malicious Code. In these EdgeOne Terms, "Malicious Code" means code, files, scripts, agents or programs intended to do harm, including viruses, worms, time bombs and Trojan horses;
2.3.4 modify, change, alter, add to, delete, or otherwise interfere with the Software, the Service or any of their components, parts, functions, modules, or data; or
2.3.5 other behaviours that may harm or damage Tencent, the Service or Software.

3. Representations, Warranties and Undertakings

3.1 You represent, warrant and undertake that you have obtained sufficient, effective and necessary consent, approval, authorization, or permission of the owners or holders of Intellectual Property Rights of the relevant Targeted Webpages ("Necessary Consents"), for:
3.1.1 using the Service on such Targeted Webpages, covering but not limited to the following activities carried out in accordance with your instructions:
3.1.1.1 accessing the relevant Targeted Webpages by the Service;
3.1.1.2 copying, reproducing and rendering content of such Targeted Webpages by the Service;
3.1.2 your subsequent use of such Rendered Content.
3.2 To the extent the Service is used to process Personal Data (e.g. Personal Data contain in Targeted Webpages), as the data controller you represent, warrant and undertake that you have obtained the valid and informed authorization and consent required from the relevant data subjects, or that you have other valid legal basis, such that your act or engaging or instructing us to process the relevant Personal Data as a data processor (pursuant to the DPSA) complies with all applicable data protection laws. Tencent shall have the right to immediately suspend the Service upon notifying you without any liability if, in its sole discretion, it is of the view that your use of the Service or the generation of Rendered Content (which includes or incorporates Personal Data) violates applicable data protection laws.
3.3 In relation to any User Data you or your end customers upload to the Service in general (including, but not limited to, text, images, audio and video, etc.), you shall ensure, and you represent, warrant and undertaking that:
3.3.1 The content of the User Data does not contain any content that violates any applicable laws or regulations, and should not contain unauthorised Personal Data of other natural persons, unauthorised intellectual property or trade secret, etc.
3.3.2 The User Data is owned by you or you have obtained sufficient, necessary and effective legal permission and authorisation from the subject of the rights involved in the User Data, and does not infringe the legitimate rights and interests of any third party (including but not limited to intellectual property rights, portrait rights, reputation rights, privacy rights, trade secrets and other legitimate rights and interests).
3.3.3 To the extent your User Data contains Personal Data, you have obtained the informed consent of the data subject of the relevant Personal Data (or separate consent if sensitive Personal Data is involved), and that the authorisation should cover Tencent's processing of Personal Data as a data processor for the purpose of providing you with the Service as set out in the DPSA; or anonymisation measures that comply with the applicable laws relating to data protection have been adopted. Otherwise, you must not upload it to the Service. Tencent shall have the right to immediately suspend the Service upon notifying you without any liability if, in its sole discretion, it is of the view that your upload of Personal Data violates applicable data protection-related laws.
3.3.4 The User Data is true, accurate, objective, varied, and suitable for the purposes of and uses in connection with the Service.

4. User Service Data

4.1 You should handle your User Data and Rendered Content provided, used or obtained in connection with this Service (collectively, "User Service Data") with reasonable caution, and ensure the legality of your User Service Data. Between the Parties, you are solely responsible for ensuring that the content, purposes and methods of acquisition and usage of such User Service Data comply with applicable laws and regulations and do not infringe any third party Intellectual Property Rights, or other proprietary or personal rights or interests, and you shall bear all liability and consequences of any violations.
4.2 You hereby grant to Tencent a non-exclusive, sublicensable license to access, copy, and use User Service Data to provide the Service, and/or otherwise use such User Service Data in accordance with these EdgeOne Terms.
4.3 You acknowledge and agree that Tencent may disclose User Service Data to third parties with or without notice to you: (1) to comply with applicable laws or protect Tencent's rights; or (2) to comply with court orders, a lawful government or law enforcement request, or other legal processes. Tencent may also block or remove User Service Data as required by applicable laws, in which case Tencent will make reasonable commercial efforts to promptly notify you if legally permissible.
4.4 You are solely responsible for maintaining and backing up User Service Data. Between the Parties, you retain any Intellectual Property Rights you may have in User Service Data.
4.5 Upon expiration of the relevant subscription or Service period, or early termination of the Service (including but not limited to early termination by mutual agreement, Service interruption due to unpaid fees, or other reasons), Tencent will immediately and automatically delete all your User Service Data, including all cached or backed-up copies, and will no longer retain any of your User Service Data.

5. Limitation and Exclusion of Liability

5.1 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAWS AND REGULATIONS AND NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THE TERMS, TENCENT DOES NOT PROVIDE ANY INDEMNITY FOR, AND DISCLAIMS ALL LIABILITY IN RESPECT OF, ANY CLAIM, DAMAGES, LOSSES, OR DISPUTE ALLEGING THAT YOUR USE OF THE SERVICE, OR THE RENDERED CONTENT, INFRINGES THIRD PARTY INTELLECTUAL PROPERTY RIGHTS OR OTHER PROPRIETARY OR PERSONAL RIGHTS.
5.2 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TENCENT DOES NOT MAKE ANY WARRANTY AS TO THE NON-INFRINGEMENT, LEGITIMACY, TRUTHFULNESS, ACCURACY, COMPLETENESS, TIMELINESS, FUNCTIONALITY, PRACTICABILITY AND APPLICABILITY TO SPECIFIC PURPOSES OF THE SERVICE, NOR DOES TENCENT GUARANTEE THAT THE SERVICE WILL BE FREE OF DEFECTS. In addition, Tencent disclaims any liability or responsibility in relation to the following:
5.2.1 Legal Liability relating to the Targeted Webpage. You shall solely bear all Claims, legal liability and responsibility arising from your use of this Service on any Targeted Webpage (including but not limited to your bypassing the Targeted Webpage's anti-crawler mechanisms, excessive or malicious access, etc.) and any legal action, economic loss claims, service restrictions, IP blocking, or any form of liability pursued by any third-party website, network service, or its owner.
5.2.2 Restrictions or Blocking by the Targeted Webpage affecting the Service. The Targeted Webpage's implementation of anti-crawler technology, security upgrades, IP blocking, or access frequency restrictions may prevent the Service from successfully accessing or rendering the Targeted Webpage, or generating Rendered Content.
5.2.3 Changes to the Content or Structure of the Targeted Webpage affecting the Service. Changes or errors in the Targeted Webpage's URL links, HTML structure, rendering logic, front-end code, or certificates may prevent the Service from parsing or rendering content, or generating Rendered Content as expected.
5.2.4 Customer-related reasons. Incorrect API call parameters, exceeding quota limits, network interruption, account arrears, or improper use of the Service by the User may affect the performance of the Service.
5.2.5 Other restrictions and exemptions from liability stipulated in the Tencent Cloud Terms of Service.

6. Indemnification

You will defend, indemnify and hold harmless Tencent, its Affiliates, and each of their respective agents, licensors, employees, officers and directors from and against any Claims to the extent they arise out of or in relation to:
6.1 your User Service Data, including without limitation, any alleged infringement or misappropriation of the Intellectual Property Rights of any third party arising from the creation, generation, use, distribution, dissemination, reproduction etc. of your User Service Data;
6.2 you or your End Users' use of the Service, including without limitation:
6.2.1 any alleged violation of Data Protection Laws by you, your End User(s), Tencent, or its Affiliate(s) in connection with such use;
6.2.2 any alleged violation of any other applicable laws and regulations by you, your End Users, Tencent, or its Affiliates in connection with such use;
6.2.3 any alleged violation of third party rights (including Intellectual Property Rights, or any other proprietary or personal rights) or legal or contractual documents, provisions, terms or conditions in connection with any Targeted Webpage by you, your End Users, Tencent, or its Affiliates; and/or
6.2.4 such use that would constitute a violation of these Terms (including but not limited to the use conditions and restrictions in Section 2 or representations, warranties and undertakings of these EdgeOne Terms).

7. Remedial Measures

In the event of any breach of these EdgeOne Terms or applicable laws and regulations, Tencent has the right to take remedial or restrictive measures, including but not limited to restricting or suspending the provision of all or part of the Service to you, terminating the provision of Service to you, and restricting or freezing your Tencent Cloud account. You shall bear all consequences and losses resulting from Tencent's remedial or restrictive measures, such as service unavailability, business suspension, or data cleanup. Tencent reserves the right to pursue other legal remedies or recourse against you in accordance with laws, regulations, and these EdgeOne Terms.
